Consumer
The Consumer is the individual purchasing the service for purposes outside their trade, business or profession. Their full name, contact details and any billing information necessary for the transaction are recorded in the individual booking confirmation.
Customer information must be supplied privately for the relevant booking and must not be published on this public page.
02. Subject & Scope
This agreement concerns the remotely purchased spa, massage or Turkish bath service described in the individual booking summary. It applies where the transaction meets the legal conditions for a distance contract.
An availability enquiry, a telephone conversation or a WhatsApp message does not automatically constitute a distance sale. The actual transaction and method of conclusion determine the applicable rules.
Mandatory protections under Turkish Consumer Protection Law No. 6502 and the applicable Distance Contracts Regulation prevail over any inconsistent provision of this agreement.
03. Individual Booking Summary
The following information must be completed and supplied to the Consumer before acceptance. The completed summary forms part of the individual agreement.

A blank or incomplete summary is not an authorisation to charge the Consumer. Changes to the agreed service or amount require agreement where legally required.
04. Pre-Contract Information & Acceptance
Before the Consumer becomes bound, the Provider must supply the legally required pre-contract information and give the Consumer an opportunity to review and correct the booking details. The completed agreement and confirmation must be supplied in a form the Consumer can retain.
Any order creating a payment obligation must make that obligation clear before acceptance. Clicking a contact link, requesting information or selecting a massage in an enquiry window does not by itself constitute a paid order.
Acceptance of the individual agreement must be recorded through the actual booking process. This public page does not collect signatures, record acceptance or process payments.
Agreement to receive marketing messages and any separate consent required for early service performance must not be treated as automatically given through general acceptance.
05. Payment & Additional Charges
The Consumer pays only the total and any optional extras expressly agreed in the completed booking summary. A deposit is required only if disclosed and agreed before the purchase is concluded.
The Provider will identify the accepted payment method and payment recipient. Payment records and any legally required invoice or receipt will relate to the actual legal service provider.
No additional treatment, product or facility may be charged merely because it was suggested during a visit. Optional additions require the Consumer’s agreement.
If a payment fails or a discrepancy arises, the parties will clarify the transaction before proceeding. A failed payment attempt is not proof that payment was successfully collected.
06. Performance of the Service
The Provider will deliver the confirmed service at the agreed venue, date and time, in accordance with its description and applicable professional and legal obligations.
The Consumer should communicate relevant comfort requirements and safety concerns before treatment begins. Where suitability is uncertain, advice from an appropriately qualified healthcare professional may be necessary.
Spa and massage services are offered for relaxation and general wellbeing. They are not a substitute for medical diagnosis or treatment.
- The Consumer may request adjustments to comfort or pressure and may ask for the session to stop.
- Both parties must respect privacy, personal boundaries and professional conduct.
- Any early termination or safety-related postponement must be assessed fairly. Requesting a treatment to stop does not automatically determine the refund outcome.
- Specific therapists, rooms or additional facilities are guaranteed only if expressly included in the confirmation.
07. Booking Changes & Cancellations
Requests to reschedule or cancel should be communicated promptly through the Provider’s published contact channels. Rescheduling is subject to availability and mutual agreement.
Any cancellation deadline, no-show condition or late-arrival arrangement must be stated before the Consumer accepts the booking. No such fee is created solely by this template.
Booking-specific conditions cannot override statutory withdrawal rights or other mandatory consumer protections. A deposit is not automatically non-refundable merely because it is described as a deposit.
If the Provider proposes a material change, the Consumer will be informed. An alternative date, treatment or voucher will not be imposed in place of a refund where the Consumer is legally entitled to one.
08. Statutory Right of Withdrawal
For a qualifying distance service contract, the Consumer generally has 14 days from the date of conclusion to withdraw without giving a reason, unless a statutory exception applies. Failure to provide required withdrawal information may extend this period.
Possible exceptions
Exceptions may include services whose performance begins with the Consumer’s consent before the withdrawal period ends, and qualifying leisure services provided on a specified date or during a specified period.
The Provider must identify the applicable legal basis for the particular booking. A spa booking is not automatically exempt merely because an appointment date is selected.
Where early-performance consent is relevant, it must be addressed separately before performance begins. Reading this page or sending an availability enquiry does not constitute that consent.
Giving notice
Send an unequivocal withdrawal statement in writing or through a legally recognised durable medium to the Provider’s completed notice details. Keep evidence of sending it within the applicable period. The sample below is optional; its exact wording is not required.
To: [Provider’s full legal name and notice address / email]
I hereby give notice that I withdraw from the distance service contract identified below.
Consumer name: [Full name]
Booking reference: [Reference]
Service: [Service name]
Contract date: [Date]
Appointment date: [Date, if applicable]
Contact details: [Contact details]
Notice date: [Date]
Signature: [Only if submitted on paper]
09. Refunds & Non-Performance
Following a valid statutory withdrawal, the Provider will reimburse payments received for the relevant contract within the legally applicable period, generally 14 days from receipt of the withdrawal notice, in accordance with the required payment-method rules and without an additional refund fee.
If performance becomes impossible, the Provider must notify the Consumer and return amounts due within the applicable statutory deadlines. Events beyond the Provider’s control do not create a general right to retain payment for an unprovided service.
For other refund grounds, the timing and amount are determined by the relevant legal entitlement and the circumstances. Bank processing times do not extend the Provider’s own legal reimbursement deadline.
10. Defective Services & Liability
If a service does not meet the agreed description or legal requirements, the Consumer retains the remedies available under applicable consumer law.
These may include re-performance, repair of a resulting work where relevant, a proportionate reduction or withdrawal from the contract, subject to the applicable legal conditions. Rights to compensation remain unaffected where legally justified.
Raising an issue during the visit may help the Provider respond quickly. Failure to complain immediately does not, by itself, waive the Consumer’s statutory rights.
Nothing in this agreement excludes liability that cannot legally be excluded or imposes an automatic waiver for injury, negligence or failure to provide the agreed service.
11. Personal Information & Contract Records
Personal data required for the booking, payment and legal recordkeeping must be handled in accordance with applicable data protection law and the privacy information supplied separately to the Consumer.
Acceptance of this agreement is not blanket consent to marketing or to processing sensitive health information. The Consumer should not send unnecessary medical records, card security codes or banking passwords through general messaging channels.
The Provider must retain the records required by applicable law. The Consumer should also keep the completed agreement, pre-contract information, booking confirmation and payment records.
12. Disputes & Final Provisions
Complaints may be submitted using the Provider’s contact details. Please identify the booking, explain the concern and state the resolution requested.
The Consumer may apply to the competent Consumer Arbitration Committee or Consumer Court according to the monetary limits and procedural rules in force at the time of application. Pre-action mediation applies where required by law.
No exclusive-jurisdiction clause in this agreement removes a forum or remedy available to the Consumer under mandatory law.
Later updates to this public template do not retrospectively change an existing agreement. A change to a confirmed booking must be communicated and agreed where required.
This English text is provided for accessibility. Mandatory language, disclosure and consumer-protection requirements remain applicable. The completed individual agreement, rather than an unfilled public template, must be retained as the record of the transaction.
